What is Personal Data?

When we refer to “Personal Data” in this Policy, we mean information that identifies, relates to, describes or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a specific person. Personal Data does not include information that relates to your employment status, or information publicly available through government records, or information that has been deidentified or aggregated in a way that it cannot be used to identify a specific individual.

If you are using the Site in your capacity as an employee, all Personal Data collected from you will be governed by the terms of your employment.

What Personal Data Do We Collect?

Depending on how you use our Services, we may collect the following categories of Personal Data about you: 

Identifiers: Identifying and contact information that you may choose to provide when communicating with us including your name, any alias you go by, postal address, phone number, email address, your IP address, unique personal online identifiers like a cookie ID, employee ID number and last four of your Social Security number.

Internet Activity: Your browsing history, search history, pages you click-on on the Site, the amount of time spent on the Site, when you visited the Site, your interactions with online advertisements, the website you visited prior to or after visiting the Site. 

Commercial Information:  The content of messages you send to us, context of feedback or survey responses you send to us.

Geolocation Data: Imprecise location information, like the country and city associated with your IP address.

Job Application Information: Information you provide with you apply for an employment position with us and information collected to process your time off request.

What are the Sources of Personal Data We Collect?

We may collect Personal Data that you provide to us, that is collected automatically using technology, and from third parties in the ways described in this Policy.

PERSONAL DATA WE COLLECT ABOUT YOU FROM THIRD PARTIES
How Do We Use Personal Data?

We may collect Personal Data about you in connection with our Platform for the following purposes:

(1) To operate the Site and to improve the functionality of the Site; (2) to improve your experience when you visit the Site; (3) to develop and improve the content and services that we make available through the Site; (4) to evaluate user needs; (5) customize Site content; (7) improve your browsing and online search experience; and (8) to notify you of new features of our Site.

Who Do We Share Personal Data With?

To operate our business, we may
share Personal Data with third parties, including: 

Service Providers.  We may share Personal Data in connection with the services our service providers provide to us, including, marketing, data hosting, payment processing, legal, business, and financial advice, and fraud protection and prevention. We require these Service Providers to exercise reasonable care to protect your Personal Data and restrict their use of your Personal Data to the purposes for which we provided it to them.


Marketing and Advertising Partners. We may share Personal Data to facilitate the delivery of targeted ads, promotions and offers to you, on our behalf.
Parties to Business Transactions. In the event of an anticipated or actual merger or acquisition, bankruptcy or other sale of all or a portion of our assets, we may transfer or allow third parties to use information owned or controlled by us, including Personal Data. We reserve the right, in connection with these types of transactions, to transfer, share, assign, or sell your Personal Data and other information we have collected to third parties or to authorize such third parties to use any such information including for due diligence as part of any of the transactions described in this paragraph. We may use Personal Data to cooperate with law enforcement or other legal purposes like complying with legal and regulatory requirements, satisfying contractual obligations, cooperating with law enforcement or other governmental agencies for purposes of investigations, public safety or matters of public importance when we are legally required to do so or believe that disclosure of Personal Data is necessary or appropriate to protect the public interest, or protecting and defending against legal actions or claims.

ANONYMIZED DATA
We may use and disclose aggregated, anonymized, or de-identified information that does not identify any individual (“Anonymized Data”) for any lawful purposes, which may include purposes not described in this Policy.

SECURITY
We implement and maintain commercially reasonable information security measures designed to protect Personal Data from the risk of unauthorized access, disclosure, alteration, loss, or destruction. 
WHILE WE STRIVE TO PROTECT PERSONAL DATA, WE DO NOT GUARANTEE THE SECURITY OF PERSONAL DATA. YOU PROVIDE PERSONAL DATA AT YOUR OWN RISK.

ACCESS BY CHILDREN
The Site is not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13. If a parent or guardian learns that their child provided us with Personal Data without his or her consent, please contact us at office@freedomind.us and we will make commercially reasonable attempts to delete such Personal Data.

ACCESS OUTSIDE THE UNITED STATES
The Site is only intended for users in the United States. If you access the Site from outside the United States, you understand that the collection and processing of your Personal Data in the United States, regardless that certain governmental authorities may not consider the level of protection of Personal Data in the United States to be equivalent to that required by the European Union or other jurisdictions.

THIRD-PARTY WEBSITES AND SERVICES
For your convenience, the Site may link to, or be linked to, websites not maintained or controlled by Freedom Industries. This does not imply any affiliation with, or an endorsement, authorization, sponsorship or promotion of a non-Freedom Industries website or its owner. Freedom Industries is not responsible for the privacy policies or practices of any third-parties or any third-party websites. If you choose to access third-party websites, you do so at your own risk, and you should read the terms and conditions and privacy policies for each website that you visit.

SOCIAL MEDIA WEBSITES
Freedom Industries participates in social media platforms such as LinkedIn (“Social Media”). 

By choosing to use any third-party social media platform or choosing to share content or communications with any social media platform, you share information with the designated Social Media platform. We cannot control any policies or terms of any third-party platforms. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy. We encourage you to review those policies and terms. As a result, we cannot be responsible for any use of your Personal Data or content by a third-party platform, which you use at your own risk.

Analytics and Interest-Based Advertising Tools
We may use both persistent and session Cookies. Persistent Cookies remain on your computer after you close your session and until you delete them, while session Cookies expire when you close your browser.  We also use first-party and third-party Cookies. A first-party Cookie allows your web browser to talk to the actual website that you are visiting (i.e., the Services). A third-party Cookie allows your web browser to talk to a third-party provider providing services or features on the website you are visiting. 

We describe below some of the tools we use on our Site to collect information, including Personal Data for Targeted Advertising and Analytics and the options those tools provide to you to limit the use of remarketing or analytics for those tools.

ANALYTICS TOOLS
We use Google Analytics on our Site to learn more about how visitors navigate the Site and view content. Update Your Contact Information: You may update your contact information and communication preferences by contacting us as described below.
Delete Cookies on Your Browser: Most browsers automatically accept cookies. You can disable this function by changing your browser settings but disabling cookies may impact your use and enjoyment of the Site. You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Site. You can manually delete persistent Cookies, or Cookies that track your activity across websites, through your browser settings. 

Configure Your Device: The electronic device you use to access the Site may offer additional privacy settings; please see the device settings for details. Please note that even if you opt-out of receiving interest-based advertising, you will still receive advertisements, but they will be more general in nature.
Google Browser Add-On. To prevent this data from being used by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Using the Google Analytics opt-out browser add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Site itself or to Google. Opting out will not affect your use of the Site.

Consumer Resources: To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, visit National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. Welcome to Freedom Industries, Inc. (“Freedom Industries,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your use of the Freedom Industries website, which can be accessed at freedomind.us and other websites that link to these terms (the “Site”).
Please review the following Terms carefully. By accessing or using the Site, you agree to comply with these Terms and are entering into a binding legal contract. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR USE THE SITE.

Any unauthorized use of Freedom Industries’ name, trademark, or logos is strictly prohibited.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site or its Content ("Submissions") provided by you to us are non-confidential and shall become our sole and exclusive property, including any related intellectual property rights. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, WITH RESPECT TO YOUR ACCESS TO AND USE OF THE SITE AND THE CONTENT SHALL NOT EXCEED $100. 

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF THE SITE OR THE CONTENT OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR ACCESS TO OR USE OF THE SITE, INCLUDING CLAIMS FOR LOSS OF DATA.

THESE LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR FREEDOM INDUSTRIES WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

SOME STATES OR JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU. IN SUCH STATES OR JURISDICTIONS, THE RELEASED PARTIES’ LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
YOUR INDEMINIFICATION OF FREEDOM INDUSTRIES

You will indemnify and hold Freedom Industries harmless from any claim or demand, including reasonable legal fees, made by any third party against Freedom Industries, its affiliates, employees, contractors, trainees, journeymen, or apprentices (“Freedom Industries Parties”) to or arising out of your breach of these Terms, breach of the Acceptable Use Policy, or your breach of any law or rights of a third party.

Venue for Litigation.
Unless prohibited by applicable law, the proceedings must be brought exclusively in the United States District Court for the Eastern District of North Carolina or the state courts of North Carolina located in Edgecombe County, North Carolina, as appropriate. You agree to submit to the personal jurisdiction of each of these courts for the purposes of litigating such claims or disputes and you hereby waive your right to a jury trial, waive your right to initiate or participate in a class or collective action, and agree to remain bound by any and all limitations of liability and damages included in these Terms.
Limitation on Time to File Claims

ANY CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE OR THE CONTENT MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE DATE THE CLAIM ACCRUES OR IT WILL BE PERMANENTLY TIME BARRED.
GENERAL TERMS

Electronic Communications
The communications between you and Freedom Industries use electronic means. For contractual purposes, you: (a) consent to receive communications from us in an electronic form; and (b) agree that the Terms, agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing. The foregoing does not affect your non-waivable rights.

Severability
If any part of these Terms is held or found to be invalid or unenforceable, that portion of the agreement will be construed as to be consistent with applicable law while the remaining portions of the agreement will remain in full force and effect. 

No Waiver
Any failure or delay on our part to exercise or enforce any right or provision of these Terms or rights under applicable law shall not constitute a waiver of any such provision or rights. Our rights under these Terms survive any transfer or termination of these Terms.

Governing Law
These Terms of Use and your use of the Site are governed by the federal laws of the United States of America and the laws of the State of North Carolina, without regard to conflict of law provisions.

Assignment
You may not assign or delegate any rights or obligations under these Terms without our prior written consent, and any unauthorized assignment or delegation by you is null and void.

Cumulative Rights
The rights and remedies granted to you and Freedom Industries in these Terms are cumulative. The exercise of one shall not diminish or affect any other rights or remedies at law or in equity.

Entire Agreement.  


These Terms constitute a binding agreement between Freedom Industries and you. These Terms constitute the entire agreement between  us regarding the use of the Site and the Content.   The Terms supersede all prior understandings, agreements, negotiations, representations and warranties, regarding the subject matter of these Terms.
